These Terms of Service ("the Terms") govern your use of Shizucam ("the App").
1. Agreement to the Terms
By downloading, installing, or using the App, you are deemed to have agreed to all provisions of these Terms. If you do not agree, please do not use the App.
2. About the App
The App is an iOS camera application provided by an individual developer ("the Developer"). It offers features such as photo and video capture, side-by-side comparison, and collage creation.
The App is a general-purpose photography tool, and the manner and purpose of its use are at the user's own judgment and responsibility. The Developer is not in a position to manage or monitor how users use the App, and assumes no responsibility for the results of such use.
3. Usage Notes
Please observe the following when using the App:
- Capture photos and videos in accordance with the rules of each facility and applicable laws.
- Do not capture in ways that infringe on others' privacy.
- Do not use the App for covert recording or other illegal activities.
- Do not use the App for purposes against public order and morals.
- When capturing, please carefully verify the rights of the subjects (portrait rights, privacy rights, copyright, etc.). When photographing people, obtain their consent as necessary.
4. Prohibited Actions
The following actions are prohibited:
- Illegal photography using the App (including covert recording, unauthorized photography, and actions violating laws against capturing sexually explicit content).
- Modifying, reverse-engineering, or decompiling the App.
- Redistributing the App or any part of it to third parties.
- Using the App to infringe on the rights of third parties (portrait rights, privacy rights, copyright, etc.).
- Any other action that violates laws or that the Developer deems inappropriate.
If you violate the prohibited actions, the Developer may restrict your access without prior notice.
5. User Responsibility
The App provides a tool for photography, and all responsibility for its use rests with the user.
- The Developer assumes no responsibility for any consequences arising from use of the App, including the content of captured photos, or claims from third parties regarding the photography itself.
- The Developer assumes no responsibility for the management, storage, use, publication, or deletion of photos and videos captured using the App.
- If you cause damage to a third party by violating these Terms or any law, you will resolve such matters at your own expense and responsibility, and will not cause any inconvenience or damage to the Developer.
- If the Developer suffers damage due to your illegal acts, you will compensate the Developer for such damage.
6. Intellectual Property Rights
All intellectual property rights related to the App (copyright, trademark rights, etc.) belong to the Developer. The copyright of photos and videos captured using the App belongs to the user who captured them.
7. About the Quiet Capture Feature
The quiet capture feature of the App does not guarantee operation on every iPhone model, iOS version, or environment. Depending on device model, iOS version, settings, or other factors, the shutter sound or other sounds may unintentionally be audible.
The Developer assumes no responsibility for any damage, disadvantage, or trouble arising from the quiet capture feature. Please act at your own responsibility, without assuming that no sound will be produced.
If unexpected behavior or sound occurs, please report it through the contact form so we can use it as a reference for improvements. However, this does not constitute a guarantee of operation on all devices or a promise of individual responses.
8. Disclaimer
- The App is provided "AS IS". The Developer makes no warranty, express or implied, regarding the completeness, accuracy, reliability, safety, or fitness for a particular purpose.
- To the maximum extent permitted by law, the Developer is not liable for any direct, indirect, incidental, or consequential damage arising from use of or inability to use the App.
- The Developer is not responsible for loss, corruption, or failure to save captured data. Please back up important data on your own.
- Depending on device model, OS version, or settings, some features may be unavailable or behave differently.
- The App may add, change, or remove features without notice through updates.
- The Developer is not liable for issues or damages caused by factors outside the Developer's control, such as the communication environment, device condition, or OS specification changes.
- The Developer does not guarantee compatibility between the App and third-party apps, services, or hardware.
9. Price Changes
The App may change its pricing structure in the future (including from free to paid). Price changes may be made at the Developer's discretion without notice.
Users who downloaded the App before a price change can continue to receive updates for free through Apple's system. However, additional in-app purchases added in the future may require separate payment.
Features currently offered free of charge may become paid in future updates. Free availability is a campaign or limited-time measure, and does not guarantee any permanent right. Downloading the App does not create a right to use it free of charge in the future.
10. Changes to or Termination of the Service
The Developer may change the content of the App or terminate its provision without notice. The Developer is not responsible for any damage to users resulting from such changes or termination.
11. Changes to the Terms
The Developer may revise these Terms as necessary. Important changes will be announced within the App or on this page. Continued use of the App after revision will be deemed acceptance of the revised Terms. If you do not agree to the changes, please stop using the App.
12. Compliance with Photography-Related Laws
Laws and regulations regarding photography vary by country, region, and facility. Users are responsible for verifying and complying with the laws and rules applicable at the location where they take photos (laws against covert recording, portrait rights, privacy laws, facility photography rules, etc.).
The Developer is not in a position to provide legal advice regarding where or under what circumstances photography is permitted. Please consult a professional for legal judgment.
13. Limitation of Liability
In no event will the Developer's liability under these Terms exceed the amount actually paid by the user for the App. During any period in which the App is provided free of charge, the Developer's liability is zero.
14. Third-Party Services
The App runs on the iOS platform of Apple Inc. The Developer is not responsible for any impact on the App's operation caused by OS updates, Apple policy changes, or other acts of third parties.
15. Provision of Support and Updates
The Developer does not guarantee the provision of support or updates for the App. Support and updates are provided at the Developer's sole discretion.
Because the App is developed by an individual, support resources are limited. While we accept inquiries, individual replies will prioritize serious bugs or security-related issues. For other inquiries, receipt of the message may be considered the completion of our response.
16. Severability
If any part of these Terms is held invalid or unenforceable by law, the remaining provisions will continue to be effective.
17. Governing Law and Jurisdiction
These Terms are governed by and interpreted under Japanese law. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
